These terms of service govern access to and use of the Cultural Real Estate Audit service, available at https://nyumba.bnm-consulting.eu.
1. Legal notice
Publisher: Editions Neftis Limited, a private company limited by shares incorporated in Ireland, registered under number 657742 (Companies Registration Office, Irlande), tax reference 3653014JH.
An Irish private company limited by shares is not required to state its share capital in a legal notice, unlike a French company: this line therefore does not appear here.

2. Purpose and description of the service
Cultural Real Estate Audit is an online service that analyses a property listing provided by the user (URL and/or imported content) and produces an audit report: a diagnosis, rewriting suggestions, a photo plan, a sales brief, and technical optimisation data (JSON-LD, Open Graph).
3. Access to the service and account creation
Access to the service requires creating an account, either by email and password or via Google. The user guarantees the accuracy of the information provided at signup and is solely responsible for keeping their credentials confidential.
The service is intended for professional or personal use consistent with its purpose; it may not be used to audit listings whose content the user has no right to analyse or distribute.
4. Business model
The service operates on a freemium model: 3 full audits are offered at signup, with no commitment or payment. Beyond these free audits, access to further audits is subject to one of the following tiers, billed monthly:

The Starter and Pro tiers can be paid annually (€390 and €990), roughly two months free. Additional pay-as-you-go items may be offered; their price is then shown on the site's Pricing page.
Editions Neftis Limited is not registered for VAT: the prices above are net, with no tax added, regardless of the customer's country. Accepted payment methods: [[TO COMPLETE: card, direct debit, bank transfer - list those actually offered by your payment provider.]]
The subscription is monthly with no fixed term: it may be cancelled at any time, without notice or justification, by simple written request to the contact address above, or from the customer account area once that feature is offered there. Cancellation takes effect at the end of the current monthly billing period: the service remains accessible until that date, and no pro-rata refund is due for the period already under way. Pay-as-you-go credits already purchased remain usable after a subscription is cancelled, until exhausted. The publisher may change the pricing for the future; any price change is announced at least one month before it takes effect and applies only from the next renewal onward.
Some sites are protected by a system that refuses any automated consultation. Where that refusal prevents collection, the audit cannot be produced: the corresponding audit unit is automatically credited back to the account, and no amount is due for it. Lifting such a block is a matter for whoever is responsible for the audited site, who may allow access from our server. Failing that, the publisher may route collection through a standard network relay: it does not thereby bypass any protection measure, solve any verification test, or reach any part of the site held behind an account or a password. By ordering an audit, the customer states that they are responsible for the audited site or mandated by whoever is. The publisher does not guarantee access to a third-party site.
5. Nature of AI-generated audits
The audits, diagnoses, rewrites and sales briefs produced by the service are generated by artificial intelligence models. They are provided for purely informational purposes and have no contractual value.
They do not constitute, under any circumstances, a real-estate expert appraisal, a statutory technical diagnosis (energy performance, asbestos, lead, electrical or gas safety, or any other diagnosis required by law), or investment advice. They do not exempt the user from any legal disclosure or diagnostic obligation applicable to the sale or rental of a property.
The publisher cannot be held liable for decisions made by the user, or by any third party, based solely on the content of an audit. It is the user's responsibility to have any legal, technical or financial information verified by a qualified professional (estate agent, notary, certified surveyor) before any decision or publication.
6. User obligations
- The user warrants that they hold the necessary rights (ownership, mandate, authorisation) over the photographs, descriptions and other content they import or have analysed by the service, and indemnifies the publisher against any third-party claim in this respect.
- The user agrees not to use the service for unlawful purposes, nor to analyse content that infringes third-party rights or is defamatory.
- The user is solely responsible for how they use the reports produced, including republishing them.
7. Intellectual property
The site, its interface, its visual design, its own text and its code are the property of Editions Neftis Limited or its licensors and are protected by intellectual property law. Any unauthorised reproduction is prohibited.
Photographs and descriptions imported by the user remain the property of the user or their original rights holders; the publisher claims no rights over this content, which it processes only to produce the requested audit.
The generated audit reports (diagnosis, rewrites, sales brief, technical data) are made available to the user, who may use them freely for their own purposes related to the audited listing.
8. Suspension, termination and account deletion
The user may request deletion of their account at any time by writing to audit@bnm-consulting.eu. Deletion results in the erasure of associated audits and content, subject to any data we are legally required to retain for longer (in particular for evidentiary or security purposes).
The publisher reserves the right to suspend or delete an account, without notice in the event of a serious breach of these terms (fraudulent use, unlawful content, harm to the security of the service), and with reasonable notice in other cases.
9. Liability
The service is provided “as is”. The publisher takes reasonable steps to ensure the service's availability and reliability, without guaranteeing it will be error-free or uninterrupted. The publisher cannot be held liable for indirect damages resulting from use of, or inability to use, the service.
10. Governing law, mediation and jurisdiction
These terms are governed by Irish law. Any dispute concerning their validity, interpretation or performance falls under the exclusive jurisdiction of the courts of Ireland, subject to any mandatory public-order provisions of your own country of residence that a locally applicable law cannot deprive you of when acting as a consumer.
Under EU Directive 2013/11/EU, it is the publisher's country of establishment - Ireland - that determines which consumer mediation body is offered, regardless of your own country of residence within the European Union. If you are a consumer, you may use, free of charge and with a view to an amicable settlement, NetNeutrals EU Ltd, a mediation body approved by the Irish authority (Competition and Consumer Protection Commission) for everyday consumer disputes, Johnstown Business Centre, Johnstown, Naas, Co. Kildare, W91 C99T, Irlande (www.netneutrals.eu). This body handles cases in English, French and Spanish, and covers disputes with traders across Europe, not just in Ireland. Using mediation is free and optional for you: it does not prevent you from taking a dispute directly to court.
For any customer located outside the European Union, or acting in a professional capacity (which falls outside the mediation mechanism above, specific to EU consumers), the parties agree to seek an amicable resolution of any dispute in good faith before starting legal proceedings: the party who considers itself aggrieved notifies the other in writing of the matter in dispute, and the parties then have 30 days to attempt to settle it amicably. This prior attempt does not deprive either party of the right to subsequently bring the matter before the competent courts mentioned above.
11. Changes to these terms
The publisher may amend these terms at any time, in particular to reflect changes to the service, its business model or applicable regulation. The date of the last update appears at the top of this page. In the event of a substantial change, users will be informed by reasonable means (a banner on the site or an email) before it takes effect.
